Plan A — $99 Enrollment

SUMMARY OF KEY MEMBERSHIP TERMS — PLEASE READ BEFORE ENROLLING

These are the most important things you’re agreeing to when you join Owlet One. The full terms follow below. By clicking “Join Owlet One” and completing checkout, you agree to all of them.

You’re agreeing to pay the enrollment fee plus six monthly fees. The cancellation option in your account portal becomes available once your sixth monthly fee has been charged. After that point, you can cancel anytime before your next billing date (as shown in your portal) to avoid future charges.

Charges will appear as “OWLET” on your billing statement.

1. About These Terms

1.1 What This Document Is

These Membership Program Terms (“Membership Terms”) govern your enrollment in and use of the Owlet One membership program (the “Membership” or “Program”) offered by Owlet Baby Care, Inc. (“Owlet,” “we,” or “us”).

These Membership Terms are additional terms that supplement and form part of Owlet’s Terms and Conditions at owletcare.com/pages/terms-and-conditions (the “General Terms”). If there’s a conflict between these Membership Terms and the General Terms on something covered here, these Membership Terms control. Everything else is governed by the General Terms.

By clicking “Join Owlet One” or otherwise completing enrollment, you’re telling us you’ve read and agree to these Membership Terms, the General Terms, and our Privacy Policy, and that you’re entering into a binding legal agreement with us.

Owlet One is available exclusively on owletcare.com.

1.2 Who Can Join

To enroll you need to: (a) be at least 18 years old; (b) live in the United States; (c) have a valid payment method; and (d) agree to these Membership Terms. Enrollment is limited to one Membership per customer. Owlet One includes new hardware as part of the Membership and is not available as a software-only or platform-only add-on.

1.3 Definitions

“Enrollment Fee” means the one-time payment charged at checkout ($99).

“Monthly Fee” means the recurring monthly charge ($19/month).

“Enrollment Date” means the date you complete checkout and your Enrollment Fee is successfully processed.

“Billing Date” means the date each month your Monthly Fee is charged, beginning approximately 30 days after your Enrollment Date.

“Minimum Commitment Period” means the period beginning on your first Billing Date and ending after your sixth consecutive Monthly Fee has been charged.

“Minimum Obligation” means the total you’ve agreed to pay: the Enrollment Fee plus 6 Monthly Fees ($213 total).

“Hardware” means the specific Dream Sock monitor and Dream Sight camera units shipped to you following enrollment.

“Owlet360” means Owlet’s digital insights and parenting support platform, access to which is included during active Membership.

“Member Benefits” means the full set of benefits described in Section 4.

2. Enrollment and Billing

2.1 How Enrollment Works

Your Membership is formed when: (a) you check the acknowledgement box confirming you agree to these Membership Terms; and (b) you complete your purchase and your Enrollment Fee is successfully processed. We’ll send you a written confirmation by email summarizing your plan, your first Billing Date, and your Minimum Obligation.

2.2 Automatic Renewal and Billing

Your Membership renews automatically every month. Your Monthly Fee is charged to your payment method automatically on each Billing Date, without any further action on your part, and continues until you cancel. We’ll send you a reminder before each recurring charge.

We use Recharge, Inc. as our subscription management platform. Recharge administers your billing schedule, processes recurring charge requests through third-party payment processors, and provides your account portal. Recharge is our service provider, but is not a party to your Membership agreement nor your payment processor. We remain solely responsible to you for all obligations under these Membership Terms. Your billing information is processed by Recharge subject to Recharge’s Data Processing Addendum (available at rechargepayments.com/dpa).

2.3 Your Payment Method

By enrolling, you’re authorizing us and Recharge to charge your payment method for the Enrollment Fee at checkout and for each Monthly Fee on each Billing Date. You can update your payment method at any time through your account portal at owletcare.com/account/login.

2.4 Your 6-Month Minimum Commitment

When you enroll, you’re agreeing to pay the Minimum Obligation. That means the Enrollment Fee plus six Monthly Fees, charged in sequence. All six Monthly Fees will be charged regardless of how much you use the Membership during that time.

The cancellation option will not be available in your portal until your sixth Monthly Fee has been charged. This reflects the payment commitment you made at enrollment, which is fully disclosed here and at checkout. Your portal will show you the date your sixth monthly fee is scheduled to be charged and the date your cancellation option becomes available. 2.5 Failed Payments and Your Minimum Obligation

If a payment fails, we’ll notify you and work to resolve it. If we’re unable to collect payment after reasonable attempts, we may suspend access to Owlet360 and other digital features, and we may cancel your Membership. Suspension or cancellation for non-payment doesn’t release you from any remaining portion of your Minimum Obligation.

2.6 Taxes

You’re responsible for all applicable taxes. We’ll collect sales tax where required by law based on your shipping address.

2.7 HSA/FSA Eligibility

The Enrollment Fee for Owlet One is HSA/FSA eligible. Monthly Fees are not currently HSA/FSA eligible. Eligibility for reimbursement depends on your plan administrator’s determination and applicable IRS guidelines, and we can’t guarantee eligibility for any individual member.

3. Cancellation

3.1 Cancelling After Your Minimum Commitment Period

After your Minimum Commitment Period ends, you can cancel at any time using the self-service cancellation option in your account portal at owletcare.com/account/login. That option is available 24 hours a day, 7 days a week. You can also cancel by emailing [email protected] or by calling (844) 334-5330.

Cancellation takes effect at the end of your then-current billing period. You’ll keep access to Member Benefits through your last paid billing period. No further Monthly Fees will be charged after cancellation is processed. We’ll confirm your cancellation by email.

3.2 During Your Minimum Commitment Period

During the Minimum Commitment Period, cancellation will not be available through your account portal. If you want to discuss your Membership during that time, contact us at [email protected] or (844) 334-5330. We may, in our sole discretion, accommodate requests to exit the program early; any such accommodation is subject to terms we determine at that time, which may forgive payment of all or a portion of your remaining Minimum Obligation, and does not constitute a general waiver of our right to enforce the Minimum Obligation.

3.3 What Happens to Hardware When You Cancel

Your Hardware is yours to keep when you cancel. Your continued use of your Hardware after cancellation is governed by the applicable limited warranty and the General Terms. Dream Sock and Dream Sight will continue to work through the standard Owlet Dream App after you cancel. Dream Sock will also continue to work as a standalone device. Owlet360 is a Membership benefit and access ends when your Membership does.

3.4 If We Cancel Your Membership

We can terminate or suspend your Membership right away if you materially breach these Membership Terms, engage in fraudulent activity, or misuse Hardware. Our cancellation-for-cause does not release you from any portion of the Minimum Obligation that has already accrued at the time of termination.

4. What’s Included in Your Membership

4.1 Core Benefits

As an active member, you get:

  • Hardware: The Dream Sock monitor (FDA-cleared pulse rate and oxygen saturation monitor, for infants ages 1–18 months weighing 6–30 lbs) and Dream Sight camera (HD video with night vision and two-way audio) included in your Membership, and shipped immediately when you enroll.
  • Owlet360 access: Full access to the Owlet360 platform for live readings, historical trends, and parenting insights while your Membership is active.
  • Extended warranty: A 2-year limited warranty applies to Hardware provided through your Membership, subject to Owlet’s warranty terms.
  • VIP support: Priority access to our customer support team by phone and chat.
  • Member gift drops: Curated gift packages at membership milestones, as described in Section 4.2.
  • Partner perks: Exclusive discounts and offers from third-party brand partners, as described in Section 4.3.

4.2 Member Gift Drops

We send curated gift packages timed to membership milestones. Specific contents and timing are communicated to members separately and are subject to change. Gift drops have no cash value and can’t be exchanged or redeemed for cash.

4.2.1 Opt-In Requirement

Some physical gift drops require you to confirm certain information such as your shipping address, or your size preference for sized items, within 14 days of our request. If you don’t respond in time, that benefit is forfeited for that milestone.

4.3 Partner Perks

Partner perks come from independent third parties, not from Owlet. Your Membership may include discounts, promo codes, and offers from brand partners. These are subject to change or discontinuation at any time without notice. We don’t make any promises about their availability, quality, or value. Your use of any partner perk is governed by that partner’s own terms. We’re not responsible for anything a partner does or doesn’t do, or for any loss that results from your use of a partner perk. Partner perk codes have no cash value.

Changes to partner perks aren’t a material change to your Membership and don’t give you the right to cancel before completing your Minimum Obligation.

A summary of available partner perks at the time you enroll will be presented to you at checkout.

4.4 Changes to Benefits

We’ll use commercially reasonable efforts to deliver Member Benefits as described. We can substitute, modify, or discontinue non-core benefits (including partner perks and gift drop contents) at any time. For material changes to core benefits (Hardware, Owlet360 access, VIP support, or the extended warranty), we’ll give you at least 30 days’ advance notice. If we make a material change to core benefits that’s adverse to you, you may cancel and will not be responsible for any remaining Monthly Fees that would otherwise have been due under your Minimum Obligation. Monthly Fees already charged are non-refundable unless otherwise required by applicable law. To cancel under this provision, contact us at [email protected] within 30 days of receiving notice of the change.

4.5 This Is a Membership, Not a Purchase

Important. Hardware and other items you receive through your Membership are included as Membership benefits. They’re not sold to you separately, not provided on a financing or installment basis, and don’t represent a credit transaction. The value figures in our marketing materials show Owlet’s standalone retail prices for comparison purposes only.

5. Returns and Refunds

5.1 Hardware Included with Membership

Owlet’s standard satisfaction guarantee and return policy don’t apply to Hardware included with Owlet One Membership. Hardware provided through your Membership can’t be returned for a refund of your Enrollment Fee or Monthly Fees. Nothing in this section limits any rights you may have under applicable state consumer protection law.

5.2 Monthly Fee Refunds

Monthly Fees are generally non-refundable. As a customer service accommodation, we may provide a one-time courtesy billing credit of one Monthly Fee per Membership, for documented service failures or significant product issues. Reach us at [email protected]. Credits are applied as a reduction to your next Monthly Fee charge and do not reduce the number of Billing Cycles remaining in your Minimum Commitment Period.

5.3 Enrollment Fee

Your Enrollment Fee is non-refundable.

5.4 Defective Hardware

If Hardware arrives defective, contact VIP support within 30 days at (844) 334-5330 or [email protected]. Defective hardware is handled through our warranty process. We’ll repair or replace it at our option, and you don’t need to return the defective unit before we send a replacement.

6. Accounts, Data, and Privacy

6.1 Your Account

To access Member Benefits, including Owlet360 and device features, you need a valid Owlet account. Your Membership is tied to the email address you provide at enrollment and can’t be transferred. You are responsible for all activity under your account, so keep your account credentials confidential.

6.2 Gifted Memberships

If Owlet One is purchased as a gift, the purchaser is the account holder and is responsible for all billing, including the Minimum Obligation. The account holder can update payment method and shipping address at any time through the account portal. Anyone using Hardware through a gifted Membership is subject to the device requirements in Section 7.

6.3 Privacy

When you use your Membership and the associated Hardware and software, we collect personal information and handle it in accordance with our Privacy Policy at owletcare.com/pages/privacy-policy. By enrolling, you agree to the Privacy Policy. The data practices described in the General Terms, including how we handle de-identified health data, also apply to your Membership.

6.4 Subscription and Payment Data

Your billing information is processed by a subscription management platform subject to applicable data processing agreements.

7. Hardware, Platform, and Important Safety Information

7.1 Dream Sock

Dream Sock is an FDA-cleared Class II over-the-counter medical device indicated for routine, in-home surveillance of healthy babies ages 1–18 months weighing between 6 and 30 lbs. Dream Sock monitors pulse rate and oxygen saturation values, displays trends in those values, and provides a notification when values move outside preset ranges. Dream Sock is not intended to provide notification for every episode of an elevated or depressed pulse rate or low oxygen saturation; notifications are provided only when sufficient data are available for analysis, and the notifications and associated data are intended to supplement, not replace, a caregiver’s decision to seek medical guidance. The complete Indications for Use, cleared claims, contraindications, warnings, and directions for use are set forth in the Instructions for Use (IFU) provided with your Dream Sock. You must read the IFU in its entirety before using Dream Sock. Nothing in these Membership Terms or our marketing materials expands the cleared indications of Dream Sock beyond those set forth in the IFU.

7.2 Important Limitations — Dream Sock

DREAM SOCK IS NOT INTENDED TO DIAGNOSE, CURE, TREAT, ALLEVIATE, OR PREVENT ANY DISEASE OR HEALTH CONDITION. IT IS NOT A SUBSTITUTE FOR THE ADVICE, DIAGNOSIS, OR TREATMENT OF A QUALIFIED HEALTHCARE PROVIDER. DREAM SOCK IS NOT A SUBSTITUTE FOR ADULT SUPERVISION, GOOD PARENTING PRACTICES, OR SAFE SLEEP PRACTICES. DREAM SOCK DOES NOT DETECT, DIAGNOSE, OR REDUCE THE RISK OF SUDDEN INFANT DEATH SYNDROME (SIDS) OR SUDDEN UNEXPECTED INFANT DEATH (SUID).

Dream Sock is not indicated for: children with ongoing health conditions (consult a healthcare professional before use); children who require physician-recommended monitoring for chronic cardiovascular or respiratory conditions; children weighing less than 6 lbs or more than 30 lbs; or children younger than 1 month or older than 18 months. If you have concerns about your child’s readings, or if your child’s symptoms are serious or getting worse, contact your healthcare provider.

7.3 Medical Emergencies

If you think your child is having a medical emergency, call 911 or your doctor immediately. Do not rely solely on Dream Sock data to assess your child’s condition. Never disregard professional advice or delay in seeking treatment because of information you receive from Dream Sock or Owlet360.

7.4 Dream Sight Camera

Dream Sight is a consumer video camera product. It’s not an FDA-regulated medical device and doesn’t monitor vital signs. Dream Sight works through the Owlet Dream App and continues to work as a standard camera after your Membership ends.

7.5 Owlet360

Owlet360 is a consumer digital platform. It’s not a medical service, doesn’t provide medical advice, and isn’t a substitute for clinical care. Information in Owlet360 is for informational and tracking purposes only.

8. Warranties, Liability, and Other Terms

8.1 How the General Terms Apply

These Membership Terms incorporate the General Terms by reference. The following sections of the General Terms apply in full to your Membership: intellectual property and software licensing (Section 2); privacy (Section 3); warranties and disclaimers (Section 6); dispute resolution and binding arbitration (Section 7); liability (Section 8); and governing law (Section 10). Disputes are subject to binding arbitration and class action waiver as set forth in the General Terms. Governing law is Utah.

8.2 Warranties and Disclaimers

OTHER THAN AS EXPRESSLY SET OUT IN THESE MEMBERSHIP TERMS OR THE GENERAL TERMS, WE DON’T MAKE ANY SPECIFIC PROMISES ABOUT THE MEMBERSHIP, HARDWARE, OR ANY ASSOCIATED SERVICES. WE PROVIDE THEM “AS IS” AND ON AN “AS AVAILABLE” BASIS WITHOUT ANY WARRANTY, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DON’T WARRANT THAT DREAM SOCK WILL DETECT EVERY INSTANCE OF ABNORMAL PULSE RATE OR OXYGEN SATURATION, OR THAT OWLET360 OR DREAM SIGHT WILL ALWAYS BE AVAILABLE OR ERROR-FREE.

8.3 Our Liability

WHEN PERMITTED BY LAW, WE WON’T BE RESPONSIBLE FOR LOST PROFITS, FINANCIAL LOSSES, OR INDIRECT, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR MEMBERSHIP. TO THE EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIMS RELATED TO YOUR MEMBERSHIP IS LIMITED TO THE TOTAL AMOUNT YOU HAVE ACTUALLY PAID TO US IN MEMBERSHIP FEES, INCLUDING YOUR ENROLLMENT FEE AND ALL MONTHLY FEES, IN THE SIX MONTHS BEFORE THE CLAIM.

Nothing in these Membership Terms limits or excludes any liability that can’t be limited or excluded under applicable consumer protection law, including rights you may have under the laws of your state.

8.4 Changes to These Terms

We may modify these Membership Terms with at least 30 days’ notice by email to the email address associated with your Owlet account, except that changes required by law may take effect sooner. If you keep using your Membership after the effective date of a change, that means you’ve accepted it. If you don’t accept a change, you can cancel as described in Section 3. If a change materially and adversely affects your core benefits, you can cancel during your Minimum Commitment Period without further obligation, as described in Section 4.4.

Different versions of these Membership Terms apply to members based on the version in effect when they enrolled. We’ll maintain records of each version.

8.5 Complete Agreement

These Membership Terms, together with the General Terms, the Privacy Policy, and the disclosures shown to you at checkout, make up the complete agreement between you and us for your Membership.

These Membership Terms don’t create any third-party beneficiary rights. If we don’t take action on a violation right away, that doesn’t mean we’ve given up our right to act later. If a term turns out to be unenforceable, that doesn’t affect the rest of these Membership Terms.

Cancellation takes effect at the end of your then-current billing period. You’ll keep access to Member Benefits through your last paid billing period. No further Monthly Fees will be charged after cancellation is processed. We’ll confirm your cancellation by email.

3.2 During Your Minimum Commitment Period

During the Minimum Commitment Period, cancellation will not be available through your account portal. If you want to discuss your Membership during that time, contact us at [email protected] or (844) 334-5330. We may, in our sole discretion, accommodate requests to exit the program early; any such accommodation is subject to terms we determine at that time, which may forgive payment of all or a portion of your remaining Minimum Obligation, and does not constitute a general waiver of our right to enforce the Minimum Obligation.

3.3 What Happens to Hardware When You Cancel

Your Hardware is yours to keep when you cancel. Your continued use of your Hardware after cancellation is governed by the applicable limited warranty and the General Terms. Dream Sock and Dream Sight will continue to work through the standard Owlet Dream App after you cancel. Dream Sock will also continue to work as a standalone device. Owlet360 is a Membership benefit and access ends when your Membership does.

3.4 If We Cancel Your Membership

We can terminate or suspend your Membership right away if you materially breach these Membership Terms, engage in fraudulent activity, or misuse Hardware. Our cancellation-for-cause does not release you from any portion of the Minimum Obligation that has already accrued at the time of termination.

4. What’s Included in Your Membership

4.1 Core Benefits

As an active member, you get:

  • Hardware: The Dream Sock monitor (FDA-cleared pulse rate and oxygen saturation monitor, for infants ages 1–18 months weighing 6–30 lbs) and Dream Sight camera (HD video with night vision and two-way audio) included in your Membership, and shipped immediately when you enroll.
  • Owlet360 access: Full access to the Owlet360 platform for live readings, historical trends, and parenting insights while your Membership is active.
  • Extended warranty: A 2-year limited warranty applies to Hardware provided through your Membership, subject to Owlet’s warranty terms.
  • VIP support: Priority access to our customer support team by phone and chat.
  • Member gift drops: Curated gift packages at membership milestones, as described in Section 4.2.
  • Partner perks: Exclusive discounts and offers from third-party brand partners, as described in Section 4.3.

4.2 Member Gift Drops

We send curated gift packages timed to membership milestones. Specific contents and timing are communicated to members separately and are subject to change. Gift drops have no cash value and can’t be exchanged or redeemed for cash.

4.2.1 Opt-In Requirement

Some physical gift drops require you to confirm certain information such as your shipping address, or your size preference for sized items, within 14 days of our request. If you don’t respond in time, that benefit is forfeited for that milestone.

4.3 Partner Perks

Partner perks come from independent third parties, not from Owlet. Your Membership may include discounts, promo codes, and offers from brand partners. These are subject to change or discontinuation at any time without notice. We don’t make any promises about their availability, quality, or value. Your use of any partner perk is governed by that partner’s own terms. We’re not responsible for anything a partner does or doesn’t do, or for any loss that results from your use of a partner perk. Partner perk codes have no cash value.

Changes to partner perks aren’t a material change to your Membership and don’t give you the right to cancel before completing your Minimum Obligation.

A summary of available partner perks at the time you enroll will be presented to you at checkout.

4.4 Changes to Benefits

We’ll use commercially reasonable efforts to deliver Member Benefits as described. We can substitute, modify, or discontinue non-core benefits (including partner perks and gift drop contents) at any time. For material changes to core benefits (Hardware, Owlet360 access, VIP support, or the extended warranty), we’ll give you at least 30 days’ advance notice. If we make a material change to core benefits that’s adverse to you, you may cancel and will not be responsible for any remaining Monthly Fees that would otherwise have been due under your Minimum Obligation. Monthly Fees already charged are non-refundable unless otherwise required by applicable law. To cancel under this provision, contact us at [email protected] within 30 days of receiving notice of the change.

4.5 This Is a Membership, Not a Purchase

Important. Hardware and other items you receive through your Membership are included as Membership benefits. They’re not sold to you separately, not provided on a financing or installment basis, and don’t represent a credit transaction. The value figures in our marketing materials show Owlet’s standalone retail prices for comparison purposes only.

5. Returns and Refunds

5.1 Hardware Included with Membership

Owlet’s standard satisfaction guarantee and return policy don’t apply to Hardware included with Owlet One Membership. Hardware provided through your Membership can’t be returned for a refund of your Enrollment Fee or Monthly Fees. Nothing in this section limits any rights you may have under applicable state consumer protection law.

5.2 Monthly Fee Refunds

Monthly Fees are generally non-refundable. As a customer service accommodation, we may provide a one-time courtesy billing credit of one Monthly Fee per Membership, for documented service failures or significant product issues. Reach us at [email protected]. Credits are applied as a reduction to your next Monthly Fee charge and do not reduce the number of Billing Cycles remaining in your Minimum Commitment Period.

5.3 Enrollment Fee

Your Enrollment Fee is non-refundable.

5.4 Defective Hardware

If Hardware arrives defective, contact VIP support within 30 days at (844) 334-5330 or [email protected]. Defective hardware is handled through our warranty process. We’ll repair or replace it at our option, and you don’t need to return the defective unit before we send a replacement.

6. Accounts, Data, and Privacy

6.1 Your Account

To access Member Benefits, including Owlet360 and device features, you need a valid Owlet account. Your Membership is tied to the email address you provide at enrollment and can’t be transferred. You are responsible for all activity under your account, so keep your account credentials confidential.

6.2 Gifted Memberships

If Owlet One is purchased as a gift, the purchaser is the account holder and is responsible for all billing, including the Minimum Obligation. The account holder can update payment method and shipping address at any time through the account portal. Anyone using Hardware through a gifted Membership is subject to the device requirements in Section 7.

6.3 Privacy

When you use your Membership and the associated Hardware and software, we collect personal information and handle it in accordance with our Privacy Policy at owletcare.com/pages/privacy-policy. By enrolling, you agree to the Privacy Policy. The data practices described in the General Terms, including how we handle de-identified health data, also apply to your Membership.

6.4 Subscription and Payment Data

Your billing information is processed by a subscription management platform subject to applicable data processing agreements.

7. Hardware, Platform, and Important Safety Information

7.1 Dream Sock

Dream Sock is an FDA-cleared Class II over-the-counter medical device indicated for routine, in-home surveillance of healthy babies ages 1–18 months weighing between 6 and 30 lbs. Dream Sock monitors pulse rate and oxygen saturation values, displays trends in those values, and provides a notification when values move outside preset ranges. Dream Sock is not intended to provide notification for every episode of an elevated or depressed pulse rate or low oxygen saturation; notifications are provided only when sufficient data are available for analysis, and the notifications and associated data are intended to supplement, not replace, a caregiver’s decision to seek medical guidance. The complete Indications for Use, cleared claims, contraindications, warnings, and directions for use are set forth in the Instructions for Use (IFU) provided with your Dream Sock. You must read the IFU in its entirety before using Dream Sock. Nothing in these Membership Terms or our marketing materials expands the cleared indications of Dream Sock beyond those set forth in the IFU.

7.2 Important Limitations — Dream Sock

DREAM SOCK IS NOT INTENDED TO DIAGNOSE, CURE, TREAT, ALLEVIATE, OR PREVENT ANY DISEASE OR HEALTH CONDITION. IT IS NOT A SUBSTITUTE FOR THE ADVICE, DIAGNOSIS, OR TREATMENT OF A QUALIFIED HEALTHCARE PROVIDER. DREAM SOCK IS NOT A SUBSTITUTE FOR ADULT SUPERVISION, GOOD PARENTING PRACTICES, OR SAFE SLEEP PRACTICES. DREAM SOCK DOES NOT DETECT, DIAGNOSE, OR REDUCE THE RISK OF SUDDEN INFANT DEATH SYNDROME (SIDS) OR SUDDEN UNEXPECTED INFANT DEATH (SUID).

Dream Sock is not indicated for: children with ongoing health conditions (consult a healthcare professional before use); children who require physician-recommended monitoring for chronic cardiovascular or respiratory conditions; children weighing less than 6 lbs or more than 30 lbs; or children younger than 1 month or older than 18 months. If you have concerns about your child’s readings, or if your child’s symptoms are serious or getting worse, contact your healthcare provider.

7.3 Medical Emergencies

If you think your child is having a medical emergency, call 911 or your doctor immediately. Do not rely solely on Dream Sock data to assess your child’s condition. Never disregard professional advice or delay in seeking treatment because of information you receive from Dream Sock or Owlet360.

7.4 Dream Sight Camera

Dream Sight is a consumer video camera product. It’s not an FDA-regulated medical device and doesn’t monitor vital signs. Dream Sight works through the Owlet Dream App and continues to work as a standard camera after your Membership ends.

7.5 Owlet360

Owlet360 is a consumer digital platform. It’s not a medical service, doesn’t provide medical advice, and isn’t a substitute for clinical care. Information in Owlet360 is for informational and tracking purposes only.

8. Warranties, Liability, and Other Terms

8.1 How the General Terms Apply

These Membership Terms incorporate the General Terms by reference. The following sections of the General Terms apply in full to your Membership: intellectual property and software licensing (Section 2); privacy (Section 3); warranties and disclaimers (Section 6); dispute resolution and binding arbitration (Section 7); liability (Section 8); and governing law (Section 10). Disputes are subject to binding arbitration and class action waiver as set forth in the General Terms. Governing law is Utah.

8.2 Warranties and Disclaimers

OTHER THAN AS EXPRESSLY SET OUT IN THESE MEMBERSHIP TERMS OR THE GENERAL TERMS, WE DON’T MAKE ANY SPECIFIC PROMISES ABOUT THE MEMBERSHIP, HARDWARE, OR ANY ASSOCIATED SERVICES. WE PROVIDE THEM “AS IS” AND ON AN “AS AVAILABLE” BASIS WITHOUT ANY WARRANTY, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DON’T WARRANT THAT DREAM SOCK WILL DETECT EVERY INSTANCE OF ABNORMAL PULSE RATE OR OXYGEN SATURATION, OR THAT OWLET360 OR DREAM SIGHT WILL ALWAYS BE AVAILABLE OR ERROR-FREE.

8.3 Our Liability

WHEN PERMITTED BY LAW, WE WON’T BE RESPONSIBLE FOR LOST PROFITS, FINANCIAL LOSSES, OR INDIRECT, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR MEMBERSHIP. TO THE EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIMS RELATED TO YOUR MEMBERSHIP IS LIMITED TO THE TOTAL AMOUNT YOU HAVE ACTUALLY PAID TO US IN MEMBERSHIP FEES, INCLUDING YOUR ENROLLMENT FEE AND ALL MONTHLY FEES, IN THE SIX MONTHS BEFORE THE CLAIM.

Nothing in these Membership Terms limits or excludes any liability that can’t be limited or excluded under applicable consumer protection law, including rights you may have under the laws of your state.

8.4 Changes to These Terms

We may modify these Membership Terms with at least 30 days’ notice by email to the email address associated with your Owlet account, except that changes required by law may take effect sooner. If you keep using your Membership after the effective date of a change, that means you’ve accepted it. If you don’t accept a change, you can cancel as described in Section 3. If a change materially and adversely affects your core benefits, you can cancel during your Minimum Commitment Period without further obligation, as described in Section 4.4.

Different versions of these Membership Terms apply to members based on the version in effect when they enrolled. We’ll maintain records of each version.

8.5 Complete Agreement

These Membership Terms, together with the General Terms, the Privacy Policy, and the disclosures shown to you at checkout, make up the complete agreement between you and us for your Membership.

These Membership Terms don’t create any third-party beneficiary rights. If we don’t take action on a violation right away, that doesn’t mean we’ve given up our right to act later. If a term turns out to be unenforceable, that doesn’t affect the rest of these Membership Terms.
